Apple Expands 'Apple Vision Pro' Trademark Classifications to cover Game Controllers and Case Accessories & Files for Apple VisionOS

Sep 30, 2023

This week the U.S. Patent Office (USPTO) published a patent application from Apple regarding a Separable Controlling device for games while also granting them a patent for another style of gaming and possible Apple TV box controller. Both patents pointed to the controllers being used with an HMD (Apple Vision Pro). Then on Friday, USPTO published new trademark filings from Apple that extended applications for Apple Vision Pro. One relates to gaming and the other relates to leather cases.

Extended Trademark Class for: Apple Vision Pro (#1)

Apple filed their first trademark extension under International Class 028 covering various aspects of gaming, as following;

"Electronic hand-held game units; computer game consoles; video game interactive handheld remote controls for playing electronic games; game controllers for computer games; controllers for game consoles; protective carrying cases specially adapted for handheld video games."

The new trademarks support this week's patents regarding new gaming controllers and confirms Apple's intent to dive deeper into gaming with Apple Vision Pro.

Extended Trademark Class for: Apple Vision Pro (#2)

Apple filed their second trademark extension under International Class 018 covering various possible accessories for Apple Vision Pro, as follows:

"Cases of leather or imitation leather; straps of leather or imitation leather; lanyards of leather or imitation leather; wallets of leather or imitation leather; key cases of leather or imitation leather."

Apple filed extension to both "Vision Pro" and the "Figurative Apple Vision Pro" in Hong Kong as well though with a few twists. One of the trademark filings (#306304464) covered the "Figurative" trademark version with the Apple as a graphic as illustrated below.

Secondly, Apple extended the new Apple Vision Pro Trademarks under more International Classes (#37 and 41) to cover and protect additional applications for Apple Vision Pro as follows:

Class 18: Luggage; suitcases; trunks; all purpose carrying bags; backpacks; carrying cases; attaché cases; briefcases; handbags; wallets; purses; credit card cases; key cases; leather straps.

Class 28: Electronic hand-held game units; computer and video game apparatus, other than coin operated or those adapted for use with television receivers.

Class 37: Maintenance, installation, repair, and servicing of computer hardware, computer peripherals, computer software, and consumer electronic devices; technical support and troubleshooting services for computer hardware, computer peripherals, computer software, and consumer electronic devices.

Class 41: "Educational services; arranging, organizing, conducting, and presenting seminars, workshops, classes, webinars, conferences, online instruction, and distance learning programs; development, production, distribution, rental, and presentation of radio programs, television programs, motion pictures, multimedia entertainment content, podcasts, and sound recordings; providing ongoing television, radio, audio, video, podcast, and webcast programs; providing entertainment, sports, animation, music, informational, news, reality, documentary, current events, and arts and culture programming by means of telecommunications networks, computer networks, the Internet, satellite, radio, wireless communications networks, television, and cable television; providing non-downloadable entertainment, sports, animation, music, informational, news, reality, documentary, current events, and arts and culture programming; providing interactive guides for searching, selecting, recording, and archiving television programs, motion pictures, multimedia entertainment content, podcasts, and sound recordings; entertainment information; providing non-downloadable computer games, electronic games, interactive games, and video games."

Apple VisionOS

Apple has filed for the figurative version of "Apple VisionOS" in both Hong Kong and the EU. Both were filed with the "V" in visionOS capitalized. Whether this was deliberate or an Apple Legal filing error is unknown at this time.

Both filings for Apple VisionOS listed coverage under International Classes 9, 38 and 42. We've presented the EU listing below for their brevity. The Hong Kong filing had their class descriptions (not shown) pages long.

Class 09: "Computer software; computer operating system software."

Class 38: "Broadcasting and transmission of voice, data, images, music, audio, video, television, movies, radio, podcasts, games, and other multimedia by means of telecommunications networks, computer networks, the Internet, satellite, radio, wireless communications networks, television, and cable; broadcast and transmission of streamed images, music, audio, video, television programs, movies, radio, podcasts, games and other multimedia content by means of telecommunications networks; providing access to telecommunications networks, computer networks, and the Internet; communication by computers; providing telecommunications connections to a global computer network."

Class 42: "Design and development of computer software; computer software consultancy; computer technology consulting; providing non-downloadable software."

It should be noted that international trademark classes that Apple files their trademarks under are important as the trademark registration will only protect those classes that have been identified in their original application. In a legal battle, the classes filed for originally could make or break a legal case.
